Terms of service

Scope

These Terms and Conditions apply to all orders you submit to The Christmas Light Emporium, LLC, a Texas limited liability company (the "Company"), through this website. By placing an order, you agree to be bound by these Terms and Conditions.

Orders & Order Acceptance

All orders are subject to acceptance by the Company. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Acceptance occurs when a shipping notification is sent to the email address you provided. All orders are subject to availability, and the Company reserves the right at any time after receipt of your order to accept or decline your order, or to supply less than the quantity you ordered of any item.

Price & Payment

Prices may change at any time. Once your order has been confirmed, a later price change will not affect your order.

7-Day Price Protection. If an item you purchase goes on sale for a lower price within 7 days of placing your order, we will issue you store credit for the difference plus 10% of the difference. Just email help@thechristmaslightemporium.com with your order number.

Payment for all orders, unless otherwise agreed in writing by the Company, must be made prior to order confirmation, through the payment services designated by the Company. If the Company is unable to collect payment through the payment service, the Company will invoice you, and you agree to pay the amount due within ten (10) days from the date of the invoice in the manner designated on the invoice.

In addition to the price shown on this website, you are responsible for any applicable sales tax, other tax or governmental levy, and, where applicable, shipping costs and customs duties and fees associated with your order.

If An Item Runs Out Of Stock

Occasionally an item runs out of stock after an order is placed. We will always offer you all available options to fulfill your order. If we simply cannot fill an order, it will be cancelled and refunded as store credit, or refunded to your original payment method at your request. If an order contains both in-stock and out-of-stock items, we will contact you before shipment with your options. If we do not hear back from you within 5 business days, we will ship the in-stock items, cancel the out-of-stock items, and issue store credit for the out-of-stock items — or a refund to your original payment method at your request.

Order Cancellations & Changes

Need to cancel or change an order? Contact us at help@thechristmaslightemporium.com as soon as possible. If your order has not yet shipped, we will cancel it and refund you in full. Once an order has shipped it can no longer be cancelled or changed — but our refund policy has you covered.

Please note that most orders — and expedited orders especially — ship quickly, often within hours, so the cancellation window can be very short. We will honor any cancellation request that reaches us before your order ships, but we cannot guarantee a request will arrive in time.

Digital download items (such as projection effects, ebooks, and music) are delivered immediately and are final sale; they cannot be cancelled or refunded.

Returns & Exchanges

Returns, exchanges, and store credit are governed by our Refund Policy. Start any return, exchange, or warranty claim at our returns center.

Warranty

Our house-brand products are covered by the Reindeer Proof™ Warranty, which we provide and service ourselves. Coverage periods, claim instructions, and full warranty terms are on our warranty page. For all other items, the warranty is that of the product's manufacturer and not The Christmas Light Emporium; please refer to the manufacturer's warranty information in the packaging or on the manufacturer's website.

Limitation Of Liability

Other than the warranty of title, The Christmas Light Emporium makes no warranty on the products sold other than our house-brand "The Christmas Light Emporium" products that we design, manufacture, or direct import. Neither The Christmas Light Emporium nor the product manufacturers make any warranty other than the Limited Warranty of the applicable product manufacturer. To the full extent of applicable law, The Christmas Light Emporium provides the products "AS IS AND WITH ALL FAULTS" and hereby disclaims all other warranties and conditions, express, implied, or otherwise, including, but not limited to, any implied warranties of fitness for a particular purpose, merchantability, or non-infringement with regard to any products.

To the full extent permitted by applicable law, neither The Christmas Light Emporium nor the product manufacturers shall be liable to you or anyone else for direct, indirect, incidental, or consequential damages, including, but not limited to, lost profits or loss of business, as the result of the failure of a product, even if The Christmas Light Emporium or the product manufacturer has been advised of the possibility of such damages. The entire liability of The Christmas Light Emporium and the product manufacturers related to the use of, or inability to use, the products shall be limited to the purchase price of the product paid by you. Some state and federal laws, if applicable, do not allow limitations of implied warranties or the exclusion or limitation of certain damages. You may have additional rights if these laws are applicable.

Our collection and use of your personal information is described in our Privacy Policy.

Mobile Terms Of Service

The Christmas Light Emporium mobile message service (the "Service") is operated by The Christmas Light Emporium (“The Christmas Light Emporium”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to The Christmas Light Emporium’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of The Christmas Light Emporium through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with The Christmas Light Emporium. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP; or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other The Christmas Light Emporium mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Promotional Offers

The Christmas Light Emporium may include promotions on its website at www.thechristmaslightemporium.com from time to time that require you to enter your email address in order to participate. By entering your email address and participating in these promotions, you agree to receive marketing and promotional emails from The Christmas Light Emporium. You can unsubscribe at any time using the link at the bottom of any promotional email.

Taxes

The Christmas Light Emporium, LLC shall automatically charge and withhold the applicable sales tax for orders delivered to addresses within any jurisdiction in which we have a physical presence or an established economic nexus. For orders shipped to other states or jurisdictions, you are solely responsible for all sales taxes or other fees, duties, and taxes.

Typographic Errors

In the event a product is listed at an incorrect price due to a typographical error or an error in pricing information received from our suppliers, The Christmas Light Emporium shall have the right to refuse or cancel any orders placed for product listed at the incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged and your order is cancelled, The Christmas Light Emporium shall immediately issue a credit to your credit card account in the amount of the original order.

Dispute Resolution & Arbitration

Informal resolution first. Before filing any claim, you agree to contact us at help@thechristmaslightemporium.com and give us 30 days to work with you to resolve the issue informally. Most concerns can be resolved this way, quickly and at no cost.

Binding arbitration. If we cannot resolve a dispute informally, you and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or any purchase from the Company shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. Arbitration will be conducted in Denton County, Texas, or, at your election, by telephone, video conference, or written submissions. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and the Company each agree that any proceeding will be conducted only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, or representative action. If this class action waiver is found unenforceable, then the entirety of this Dispute Resolution & Arbitration section shall be null and void.

Governing Law

All issues and questions concerning the construction, validity, enforcement, and interpretation of these Terms and Conditions shall be governed by and construed in accordance with the domestic laws of the State of Texas, without giving effect to any choice of law or conflict of law provision (whether of the State of Texas or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Texas.

Severability

If any court determines that any provision of these Terms and Conditions is invalid or unenforceable, any invalidity or unenforceability will affect only that provision and will not make any other provision of these Terms and Conditions invalid or unenforceable. Instead, the court shall modify, amend, or limit the provision to the extent necessary to render it valid and enforceable.

Changes To These Terms; Other Conditions

These Conditions supersede any terms and/or conditions you include with any purchase order, regardless of whether The Christmas Light Emporium signs them. We reserve the right to make changes to this site and these Conditions at any time. Changes will be posted on this page.
